De nu tillämpade regelverken, som många länder har antagit i en eller annan form, baseras på ett antal internationella överenskommelser.
Avtalen har tillkommit efter hand som behov uppstått, till exempel för att kontrollera handeln med klyvbart material (&#;Nuclear Suppliers Group&#;, NSG) eller för att reglera handel med såväl kemikalier som utrustning (exempelvis rör och ventiler) som kan användas för tillverkning av kemiska stridsmedel, Australiengruppen.
CWC, Kemvapenkonventionen, föreskriver att dess parter varken direkt eller indirekt ska överföra kemiska stridsmedel till någon annan stat. I november aktualiserades CWC då Syrien som en av få kvarvarande stater undertecknade den, varefter förstöring av landets kemvapen tog sin början. undertecknade även Somalia konventionen. På samma sätt finns ett regelverk som är avsett förhindra eller åtminstone minska risken för spridning av missilteknologi (Missile Technology Control Regime, MTCR). Export Control Classification Number
Die Export Control Classification Number (kurz ECCN) ist eine alphanumerische Kennzeichnung für Exportgüter mit US-amerikanischem Ursprung.
Die ECCN wird innerhalb der amerikanischen Commerce Control List (CCL) des Bureau of Industry and Security verwendet, um Güter, die dem amerikanischen Exportkontrollrecht unterliegen, zu identifizieren. Die ECCN ist i.&#;d.&#;R. 5-stellig und beginnt mit einer Ziffer zwischen 0 und 9 (Kategorie), gefolgt von einem der fünf Buchstaben von A bis E (Produktgruppe, Gattung). Daran schließen sich 3 Ziffern (Kennung) an, z.&#;B. 3A Ggf. wird die Kennung produktspezifisch noch durch Buchstaben und einer Zahl weiter unterteilt, z.&#;B. 3Abb oder 3Ab[1]
Einen Sonderfall stellt die ECCN EAR99 dar. Diese ist für alle Güter reserviert, die zwar unter die Zuständigkeit des Handelsministeriums der Vereinigten Staaten fallen, aber nicht in der Commerce Control List aufgeführt sind.[2] Darunter fallen aus Sicht der US-Behörden auch alle Güter, die zwar außerhalb der USA, aber mit Hilfe von US-Technologie oder US-Software hergestellt wurden.[3]

An ECCN categorizes items based on the nature of the product, i.e. type of commodity, software, or technology and its respective technical parameters.
- The key in determining whether an export license is needed from the Department of Commerce is finding out if the item you intend to export has a specific Export Control Classification Number (ECCN). ECCNs are five character alpha-numeric designations used on the Commerce Control List (CCL) to identify dual-use items for export control purposes.
- First suggestion is to search the Commerce Control List (CCL) for any and all terms that may describe the details of what the product(s) is. Don’t just search with a general term or two and assume the commodity is not on the list. This may take a bit of review as it’s much better to be thorough.

An ECCN is different from a Schedule B number, which is used by the Bureau of Census to collect trade statistics. It is also different from the Harmonized Tariff System Nomenclature, which is used to determine import duties.
All ECCNs are listed in the Commerce Control List (CCL) (Supplement No. 1 to Part of the EAR), which is divided into ten broad categories, and each category is further subdivided into five product groups. The first character of the ECCN identifies the broader category to which it belongs and the second character identifies the product group (see example and boxes below).
