@misc{, abstract = {{Transnational corporations are today in general not considered to be obligated under international law to respect human rights. In states where the protection of human rights through national law is weak corporations thus may violate human rights without risking becoming subjects to legal santioncs. The purpose of this study is to investigate whether or not the conclusion of a treaty that obligates transnational corporations directly under international law to respect human rights would be, on one hand, desirable and, on the other hand, legally and practically possible. For this purpose, the study investigates the content, purpose and effect of and criticism against the UNGPs – the only instrument adopted by the UN that regulates business and human rights. For the same purpose the study furtheron examines a number of issues discussed within the legal doctrine regarding the idea of obligating transnational corporations under international law to respect human rights. In the study it is established that the UNGPs have gained support among states and corporations but that the adoption of the instrument have not resulted in any major change in corporate behaviour

Sammanfattning: What are human rights? Why do we have them? Where do they come from? The attempts to answer these questions are as many and as diverse in nature as the times in which they have been asked. For centuries philosophers held the rights as God given, but have in recent times attempted to free them of these non human origins. A sign of this shift in perceptions regarding the rights has been discernable with the founding of the UN and the establishment of the Universal Declaration of Human Rights. The articles of the European Convention on human rights were directly influenced by the Universal Declaration. In Sweden ratified the European Convention which today supercedes its national law. This essay treats human rights from different perspectives – historical, philosophical, religious and legal. Philosophy supplies two important concepts: moral universalism and relativism.     Sammanfattning: The climate change and it´s consequences have since the s received attention in a legal and political context at a national, regional and international level. The issue of climate change law has evolved from being treated as an environmental law issue to a threat that transcends territorial boundaries, to lastly being brought to attention as a human rights issue. The key issue, in a field of area that is mainly unregulated, is whether some actions result in a human rights violations or whether human rights law exist for the protection of the climate. The purpose of this thesis is to examine how international climate change law and human rights law relate to each other. States adopt international climate agreements under the impression that they are legally binding; however the fundamental idea with the agreements is voluntariness.
